Customer Pick-Up Liability Disclaimer (Will-Call)
Vehicle Ownership and Maintenance: You certify that you are the lawful owner or authorized driver of the vehicle used for the will-call order, and that it is maintained in a safe and roadworthy condition adhering to all applicable safety standards, registration, and insurance requirements.
Cargo Loading and Securing: The proper loading, securing, and protection of ordered items within your personal vehicle is solely your responsibility. Unique Custom Floors LLC cannot be held liable for any damages, losses, or injuries that may occur due to incorrect loading, securing, or handling of cargo.
Verification of Products and Quantity: You commit to inspecting and verifying products and quantities at the time of pick-up. It is critical to document any damages or missing items on the receipt promptly. Labels affixed to packaging accurately represent contents at pick-up time. Should any discrepancies be discovered, immediately notify Unique Custom Floors LLC.
Release of Liability and Indemnification: In consideration of being permitted to pick up the order using your personal vehicle, you release and hold harmless Unique Custom Floors LLC, its employees, agents, and affiliates from any liabilities, claims, demands, actions, or damages arising from the will-call order or vehicle operation.
Less Than Truckload (LTL) Shipment Disclaimer
Shipment Conditions & Third-Party Carriers: LTL shipments involve handling, loading, unloading, and transshipment by third-party carriers. Third-party carriers operate under their own terms and conditions.
Liability Limitations: Unique Custom Floors LLC shall not be liable for any damages, losses, delays, or errors occurring during transportation, handling, loading, unloading, or transshipment of LTL shipments beyond our reasonable control.
Residential Delivery: For residential shipments, delivery is strictly CURBSIDE and not indoors. Trucks will not enter driveways or manually unload materials into residences. Drivers have full discretion to determine if a delivery site presents unsafe conditions.
Verification, Damage Documentation & Claims: Upon delivery, diligently inspect all products. Document any damages in DETAIL on the delivery receipt at delivery time and capture clear photos. DO NOT mark delivery receipts with "subject to inspection", as doing so will result in carrier claim denial. Retain all damaged items and packaging for up to 90 days for inspection.
Parcel Shipment Disclaimer
Verification of Products and Quantity: Inspect and verify products and quantity at delivery time against your invoice. Document any damages or missing items on the carrier receipt and take accurate photos.
Holding Damaged Shipment: Retain damaged parcel shipments and all packaging for up to 90 days or until Unique Custom Floors LLC or the carrier provides written authorization for disposal.
Liability Limitations: Unique Custom Floors LLC is not liable for parcel damages, delays, or losses caused by carriers, weather, or circumstances beyond control.
Product Verification Prior to Installation
As the purchaser, it is imperative that you or the person installing verify that the product received matches your order, dye lot, and sample PRIOR TO INITIATING INSTALLATION.
BY COMMENCING INSTALLATION, YOU ARE IMPLICITLY CONFIRMING THAT THE PRODUCTS RECEIVED ARE ACCURATE AND MEET YOUR REQUIREMENTS. ONCE A FLOOR IS CUT, INSTALLED, OR MORE THAN ONE BOX IS OPENED, FULL REFUNDS ARE NO LONGER VIABLE.
Unique Custom Floors LLC cannot be held responsible for any labor or installation costs associated with installing an incorrect or defective product. Refrain from installation and contact us immediately if any discrepancy is found.
Membership Registration & Account Security
To register as a member, you must be at least 18 years of age and capable of entering into legally binding contracts. You agree to provide truthful, accurate, and complete information during registration.
You are responsible for maintaining the confidentiality of your username, password, and account activity. Immediately notify Unique Custom Floors LLC of any unauthorized account access.
Interstate Communications & Global Compliance
By using our website to send electronic communications (forms, orders, emails), you acknowledge that communications pass through computer networks resulting in interstate data transmissions.

Additional Safety, Warehouse, and Force Majeure Terms
Safety Advice: Videos and advice on our site are for informational purposes only. Always wear eye protection and follow safety standards when handling tools or materials.
Prolonged Warehouse Pickup: Orders left at a will-call warehouse for more than two weeks may be deemed abandoned, subject to manufacturer restocking and return shipping fees.
Force Majeure: Unique Custom Floors LLC shall be excused from performance for events beyond reasonable control, including acts of God, weather, strikes, supply chain delays, or carrier disruptions.
